I’m not certain this is IN PLAY globally or not. The reason is I have witnessed disorder in the United States of America which claims to be “just” and “legal” and “fair” and “holding up society” and “human rights”. These are not unnatural things for the human race. They also look like rules that some people forgot about, ignore, and write their own wills upon others.
Here is a RULE PROBLEM that appears to be ignored to my witness. If someone is clearly threatened, coerced, hazed into “not being themselves” are they “criminal” if they do something abnormal to society that causes “a harm”? There is a quick answer, I’m not certain legal professionals agree because they have very large books on how to think.
If you chase a horse through a marketplace and they knock over things, trample goods and injure people and small animals as they try to escape the people threatening, scaring them… Who or what is at fault? Do you shoot the horse or imprison the human(s) that brought the horse to the marketplace and chased it? In favor of small people, I feel it is very possible they have been coerced even trained to do certain things by bigger people. Even though a HORSE is typically 10x heavier than a human being, they are smaller than a human being in society. The “RULE PROBLEM” I am bringing up is some people in charge of the law and punishments may ONLY WITNESS the horse that ran through the marketplace and the resultant damage–and never “see” the ones who may have transported the animal to the market place. The law may even “stare past” the transporters and at the owner of the horse who lives 100 miles away and say it is their horse, their fault even if it was stolen from them. This is selective ruling in my humble opinion.
What I have learned is that it is very possible for legal professionals to IGNORE some facts and figures to “help the crime fit the punishment”. It is very similar to having puzzle pieces in a large jig saw puzzle… and if you are not certain how it comes together, you may accidentally put pieces together that appear to fit(and don’t actually) until the big picture is more clear. As the big picture forms and become very obvious, you may find some puzzle pieces are in the wrong places and make adjustments. You may even find some puzzle pieces are forever missing, and some are from another big picture(another jig saw puzzle entirely). What goes wrong in this “discovery” process is that some legal professionals DO NOT WANT TO MAKE ADJUSTMENTS. And refuse to allow the real big picture to be completed. Then something abnormal occurs: Denial.
Who is supposed to MAKE CERTAIN THE PUNISHMENT FITS THE CRIME? Who’s job is it to make certain all the puzzle pieces fit the big picture–which the judge and jury must rule upon? It is a team of people who are supposed to FOLLOW ALL THE RULES, not “just a few as needed”.
